つーか、これって無理があるんだよ。



１：「映画ハリーポッター」をダウンロードしようとしてダウンロードしたら、

　　中身が個人の撮った風景映像だった。



２：「山形県へ遊びに行った時の風景映像です」という名前のファイルを落としたら、

　　中身が「映画ハリーポッター」だった。



この法案が通ったとき、１，２のどちらが逮捕されるのか。



１は犯罪の意志があったのに失敗している。

２は、犯罪の意志がなかったのに、犯罪を犯してしまっている。



結局、ファイルの中身がタイトルと一致しているという保証が無い限り、

ダウンロードした人に罪は問えないはずなんだよ。



友人に「俺の写したビデオをアップしたから落としてね。ファイル名はハリーポッターだから。」

って言われて落としたら、中身が本当にハリーポッターだった場合、逮捕されるのか？



要は、ファイルの本当の中身を知っているアップロード者しか罪に問えないはずなんだよ。

ダウンロードした人間に犯罪の意志があったかどうかの証明は無理でしょ。
